SELLER DISCLOSURE MADE SIMPLE
At MAP Lawyers, we will prepare the Form 2 Seller Disclosure Statement and compile the Prescribed Certificates into a neat bundle which gets signed by the seller and provided to the agent for marketing the property. The agent can retain control over the contract of sale negotiation, and we are happy to complete a free pre-signing contract review for standard REIQ contracts prior to signing. This process supports sellers who want confidence that their seller disclosure form meets Queensland requirements.

WHAT IS A SELLER DISCLOSURE STATEMENT (FORM 2)?
From 1 August 2025, sellers are required to provide a completed Form 2 Seller Disclosure Statement and Prescribed Certificates to a buyer before the first buyer signs the contract. If you fail to do so, the buyer may be entitled to make a claim for compensation and/or have a right of termination right up until settlement.
If selling a house/land, our fee is $899.00 (GST inclusive) made up of $699.00 for professional fees plus approximately $200.00 in search costs.
If selling a property in a body corporate, our fee is $1,049.00 (GST inclusive) made up of $699.00 for professional fees plus approximately $350.00 in search costs.
We estimate that it will take approximately 1-3 business days for a house/land and 5-10 business days for lots in a body corporate. We work efficiently to deliver your property disclosure statement within these timeframes.

- Department of Main Roads Search
- Contaminated Land Search
- Zoning Search
- Body Corporate Certificate and Community Management Statement (if applicable)*
- QBCC pool register search
- Statutory encumbrances search
- A range of free online searches including QCAT Tree Register, EPA enforcement orders, the Qld Heritage Register and e-court party search.
Completion of the Form 2 is not a quick tick and flick exercise. While the law allows sellers, agents and other authorised parties to prepare the Form 2, there are compelling reasons why it is preferable for a solicitor to undertake this task:
- Legal knowledge: The Form 2 requires legal knowledge about titles, encumbrances, statutory notices, planning and environmental issues and body corporate matters. Our property solicitors at MAP are trained to interpret the search results and the governing legislation to ensure the disclosure is correct first time every time. Agents and third-party providers are expressly prohibited from giving legal advice and may not be equipped to identify all relevant issues.
- Advice: Solicitors can also provide advice on what constitutes a ‘material matter’ that should be disclosed and to avoid the risk of inadvertent omissions that could give rise to a right of termination or damages claim.
- Consequences of non-compliance can be significant: If the disclosure is missing, late, inaccurate or incomplete in relation to a material matter, the buyer may have a right of termination right up until settlement. The legal and financial consequences for the seller can be severe, including the loss of sale, forfeiture of deposit and potential damages. Solicitors must provide a higher standard of care and due diligence which minimises the risk of disputes and claims.
