Terms and Conditions of Quote
GENERAL TERMS AND CONDITIONS
- Our professional fees include a qualified lawyer managing your file as well as administrative costs such as legal stationary, phone calls, facsimile, postage, photocopying and scanning.
- Our online quote is based on a ‘standard conveyance’ – if MAP Lawyers are required to perform any work outside the scope of a standard conveyance, then additional fees may be charged at our hourly rate of $449 per hour (Inclusive GST), which is charged in 6 minute units.
- A standard conveyance does not include off the plan purchases (or contracts which are not a standard form endorsed by an Australian Real Estate Institute), multi title, leasehold or timeshare properties. It also does not include providing pre-signing contract advice, contract review services, or drafting of special conditions or contracts. In the event MAP Lawyers receives a contract which is fully exchanged/signed but contains a number of complex special conditions/annexures, additional fees may be payable to provide advice on these.
- A standard conveyance includes providing advice on the transactional elements of the conveyance. Some items we specifically consider are beyond our retainer include but are not limited to: commercial/investment advice, rural considerations, dealing with personal property security register related matters, tenancy issues, town planning and development advice, taxation and/or structuring advice, succession, matrimonial or financial implications of the conveyance (eg. capital gains tax on a future sale), GST implications arising from the transaction, mortgage advice, nominee contracts, mutual rescission of contracts, novation and assignment, insurance advice, reviewing the content of building and pest reports, protracted negotiations/disputes over contract terms, resolving disputes over property defects, renegotiating the purchase price under the contract, build contracts and building disputes, Buyer’s early occupation under licence or tenancy agreement, issues with implied warranties and terms, commission disputes with agents, Buyer/Seller default, issues with or receiving a notice to complete, dealing with work notices/show cause notices, problems with building certificates and approvals, disputes about payout figures, disputes about inclusions and exclusions, disputes about vacant possession, disputes about title defects and litigation.
- A standard conveyance is based upon a 30 day settlement period. If settlement is to be brought forward, MAP Lawyers reserves the right to charge an early settlement fee. If settlement is longer than 30 days or is extended, MAP Lawyers reserves it rights to charge an additional fee.
- Additional professional fee for properties above $3M. Please note for property values in excess of $3m, additional fees are payable on a sliding scale. This is due to the fact that higher value properties often attract higher fees due to the increased complexity and potential risks involved.
We have provided the following breakdown of additional fees below:
• Property value of $3m – $4m, an additional $500 is payable for our professional fees;
• Property value of $4m-$5m, an additional $1,000 is payable for our professional fees;
• Property value of $5m – $8m, an additional $2,000 is payable for our professional fees; and
• Property value above $8m – case by case basis. Please contact us for a quotation. - Additional Fees for Off the plan contracts. If you decide to engage us to complete your conveyance for an off the plan property and do not engage us to complete a comprehensive pre-signing contract review, our professional fee for completing the conveyance is to be calculated at the standard conveyancing rate plus $1,000. This additional fee is to recognise the fact that even though we do not issue a formal review letter, we are required to complete a comprehensive review of a non-standard contract to ensure your rights are adequately protected during the conveyance (this generally takes a number of hours), the increased complexity and potential risks associated with off the plan matters and the protracted settlement period (whereby it is likely that several extensions or updates may be sought/requested during this time). Our retainer for off the plan contracts is also $1,000 to recognise the fact that there is a considerable amount of work involved in reviewing a non-standard contract and the protracted length of off the plan contracts.
- All standard searches are charged to the client at cost – we do not charge any surcharge or mark up.
- There are a number of Optional Searches available, the selection of which may incur additional fees.
- Our quote does not include PEXA Fees, transfer duty, registration fees or other government charges. Please also note you may be subject to various lender fees if you are obtaining a loan.
- Should you require a change in the settlement date, MAP Lawyers charges $299.00 per date change.
- MAP Lawyers charges an additional fee of $999.00 for settlements 14 days or less from the Contract Date, and $499.00 for settlements 21 days or less from the Contract Date.
- Reviews of Further Statements and Disclosure Documents will incur additional fees.
- Fees for related party transfers are based upon the purchase/sale pricing for each state depending on whether you are acquiring or disposing of an asset. Please note that MAP Lawyers cannot act for both parties in the same matter.
- Our quote is indicative only and may be subject to change.
QUEENSLAND SPECIFIC
- Our free pre-signing contract review service in Queensland is limited to standard REIQ contracts and capped at 3 reviews per calendar year. Any further reviews will be charged at $249.00 per review.
- After completing a review of a standard REIQ Contract, MAP Lawyers will allow 1 round of changes and/or a further review. Should any further work be required, MAP Lawyers reserves the right to charge $249.00.
- Where there is no agent involved, MAP Lawyers will charge $499.00 to prepare the Contract of Sale and $249.00 to review a draft contract and undertake one round of negotiations.
- If a Deed of Rescission is required, MAP Lawyers charges $499.00 to prepare the Deed and $399.00 to review a draft Deed. If protracted negotiations are required, additional fees may be payable.
NEW SOUTH WALES & VICTORIA SPECIFIC
- MAP Lawyers charges a fee to prepare the Contract of Sale and disclosure documentation in NSW and VIC. Our fees depend on the complexity of the property including but not limited to, the type of property, encumbrances and easements, whether there is an owners corporation and new build warranty issues. Our fee for preparing the Contract will be deducted from the total conveyancing fee if the contract advances to settlement. Additional fees may be payable if the Contract is exchanged but rescinded.
